Marijuana Ad Requirements in Washington State

Ever wondered how to promote a new marijuana dispensary on social media, or maybe create a video for it and post it on YouTube? Under many states’ retail marijuana rules, these types of advertising may just be violating the law. Washington State law, in particular, asserts that marijuana cannot be advertised in any form or medium in a publicly owned or operated property. Below are three of the most notable advertising restrictions for medical marijuana imposed in Washington:

Marijuana advertising is not allowed to promote overconsumption of the drug. This law is similar to liquor advertising laws, hence the regular ‘drink responsibly’ slogan you’ll often see in these ads. You may want to include a similar tagline in the marijuana ads that you create.

Truth in advertising. Marijuana vendors cannot make any statements that tout marijuana as a therapeutic or curative drug.

Marijuana ads must not target persons under 21. No marijuana ad can contain a person under 21 or depict any toys, cartoon characters, TV shows, etc. that would appeal to this demographic. In addition, advertisements for marijuana can be placed within 1,000 feet of any facility that caters to those under the age of 21 including schools, libraries, child care centers, public parks, and the like.
